TravelWith by Backspace Travel LLC is an app that allows users to manage all of their travels in one place, rather than having to bounce between multiple apps. TravelWith also makes it simple to share travel plans with others, though purely on an opt-in basis.1. Acceptance of Terms
By using TravelWith (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of the Terms, you must discontinue using the App. If you violate any of the Terms of this agreement we reserve the right to terminate your account. 2. Description of Services The App provides users with travel-related services, including but not limited to bookings, itineraries, recommendations, and travel guides.3. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use this App. By using the App, you represent and warrant that you meet this age requirement.4. Account Registration
To access certain features, you may be required to register for an account. You are responsible for safeguarding your account information and for any activities under your account. During account registration, you will be required to provide your first and last name and email address. We may collect your IP address to prevent misuse. If you chooses to subscribe our paid service, you will be prompted to enter payment information:- Subscribing on the web: you will enter your payment and billing information on a Stripe-hosted webpage
- Subscribing through the app: you will provide you payment information to Apple
5. Account Terms
You are responsible for maintaining the security of your account and password. We are not liable for any loss or damage to any of your personal information.6. Use of the App
You agree to use the App only for lawful purposes. You may not:- Engage in any activity that violates any law or regulation.
- Use the App to transmit harmful or malicious software.
- Interfere with the operation of the App or servers.
- Use content on the App for training AI models.
- Abuse the unlimited trip function in a manner we find unsuitable.
- You must be a human, accounts that are deemed to be "bots" or any other automated method are not permitted and their account will be terminated.
7. User Content
You may have the ability to post reviews, photos, or other content. For content uploaded to your account, you grant TravelWith a limited license to use that content in an effort to better streamline and provide services. For content that is shared externally on the App, you grant TravelWith a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.
- You are responsible for all content posted to and activity that is registered to your account. If we find your content to be offensive, disrespectful or in any way harmful to our business we have the right to ask you to remove content and shut down your account.
- All content must comply with US Copyright law.
- You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company. You must request permission to use the Company's logos or any Service logos for promotional purposes. We reserve the right to rescind any permissions if you violate these Terms.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of the Company.
8. Paid Plans
For paid Services that offer a free trial, we explain the length of trial when you sign up. After the trial period, you need to pay in advance to keep receiving the benefits of the paid Service. If you do not pay, your account will not continue to receive paid features.- If you are upgrading from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade. For other upgrades or downgrades in plan level, the new rate starts from the next billing cycle.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, we will collect those taxes on behalf of the taxing authority and remit those taxes to taxing authorities. Otherwise, you are responsible for payment of all taxes, levies, or duties.
- Refunds are subject to our Refund Policy.
- We reserve the right to change the pricing for our paid plans to help continue offering services. We will strive to update you in a reasonable time when these services may change.
9. Intellectual Property
All content and materials on the App, including but not limited to text, graphics, logos, and software, are the property of TravelWith or its licensors and are protected by intellectual property laws.10. Termination
TravelWith reserves the right to terminate your access to the App for any reason, including but not limited to violations of these Terms. Termination will furthermore result in the deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account.- Verbal, written or other abuse (including threats of abuse or retribution) of a Company employee or officer will result in immediate account termination.
- You are solely responsible for properly canceling your account. Within each of our Services, we provide a simple no-questions-asked cancellation link. You can find instructions for how to cancel your account in our Cancellation policy. An email or phone request to cancel your account is not automatically considered cancellation. If you need help canceling your account, you can always contact [email protected].
11. Disclaimer of Warranties
The services provided by TravelWith are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties or representations of any kind, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Without limiting the foregoing, we makes no warranty that (i) the services will meet your requirements or expectations; (ii) the services will be uninterrupted, timely, secure, or error-free; (iii) the information or results that may be obtained from the use of the services will be accurate, reliable, or complete; or (iv) any errors in the services will be corrected. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law12. Limitation of Liability
In no event will TravelWith be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service.- To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
- Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.
